These terms cover the free flood-alert service operated by New River Headwaters LLC. Signing up means you accept them.
We operate creek-level sensors and send alerts when the water rises to a level that affects a place you selected. Alerts may arrive by text message, email, or push notification, depending on what you chose.
Each alert location has a level at which we consider it affected. Those levels come from real observations — someone watched the water reach a point and recorded the reading. A location with no observed level yet does not send alerts, and we say so plainly when you sign up.
Nothing. The service is free. Your mobile carrier may charge you for messages and data according to your own plan — message and data rates may apply. Message frequency varies with creek conditions; in a normal month you should expect no messages at all.
You must verify your phone number, email address, or push key before we will send anything to it. This makes sure alerts reach a real person who asked for them.
You can stop at any time:
Only sign up a phone number you control. Don't enter someone else's number without their permission.
The number alerts come from is not watched by a person. STOP and HELP are handled automatically; anything else may be read eventually but will not get a timely answer. In an emergency, call 911.
The service may let people report conditions they see — water over a road, for example. Reports are observations by members of the public, not verified facts, and are labelled as such. Only report what you have actually seen, don't report from a place you aren't, and never put yourself in danger to make one. We can remove any report.
The service is provided "as is" and "as available", without warranties of any kind. We do not warrant that alerts will be timely, accurate, delivered, or delivered at all. Equipment, power, network connectivity and third-party delivery providers are all outside our control, and any of them may fail without notice.
To the fullest extent the law allows, New River Headwaters LLC is not liable for any loss or damage — including property damage, personal injury, or economic loss — arising from your use of, or reliance on, this service; from an alert that was late, wrong, or never arrived; or from any interruption of the service. You are responsible for your own decisions about your safety and property.
We may update these terms. Material changes will be reflected in the date above. Continuing to use the service after a change means you accept the updated terms.
These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules.
